This document includes the terms and conditions that apply to the use of the services and products available through NexonHost SRL

General Terms

General Acceptable Use Policy

01. General

By accessing or using the services provided by NexonHost SRL through the websites "nexonhost.com" and "nexonhost.ro" (collectively referred to as the "Site"), you agree to be bound by these Terms of Service. If you do not agree to these Terms, you must discontinue use of our services immediately.

NexonHost SRL reserves the right to modify these Terms at any time at its discretion. Any changes will be communicated through our Site, and continued use of our services after modifications indicates acceptance of the revised Terms.

NexonHost SRL, headquartered in Lipova, Arad, Romania (B.P. Hasdeu Nr.60, VAT ID: RO34578646, Reg No: J02/594/2015), operates and manages these services ("we," "us," or "our"). For inquiries regarding these Terms, contact us at support@nexonhost.com.

02. Customer Eligibility

By registering an account with NexonHost, you confirm that:

You provide accurate and complete registration information.
You have the legal capacity to enter into contracts.
If registering on behalf of an entity, you are authorized to accept these Terms on its behalf.
Your use of the Site and services complies with applicable laws in your jurisdiction.

Access to our services is available only to registered users with an active subscription. Users must select and pay for a plan as detailed in Section 3. NexonHost reserves the right to suspend or terminate accounts at its discretion if these Terms are violated.

Users are responsible for maintaining the confidentiality of their login credentials and for any activity conducted through their accounts.

03. Pricing, Payments & Refunds

NexonHost services are available through subscription plans for 1, 3, 6, 12, or 24 months. These subscriptions are for personal use only and may not be shared, resold, or distributed without prior approval.

Pricing is listed on the Site and may change without prior notice. However, existing subscriptions will retain their original pricing for the duration of their term.

All payments are made in advance and exclude any additional processing fees.

Refund Policy

Refunds may be issued under the following conditions:

Users are eligible for a full refund within 7 days of service activation.
Refunds will not be granted if a user has engaged in prohibited activities or violated these Terms.
DDoS-protected services are non-refundable after 3 days of usage or excessive bandwidth consumption.
Cancellations after 30 days do not qualify for refunds.

Disputes/Claims

Any chargeback, claim, or payment dispute will lead to the immediate termination of all active services associated with the client. In such cases, NexonHost reserves the right to use relevant customer data, including IP logs, server logs, and dedicated server records, as evidence in resolving the dispute.

04. Prohibited Activities

Users are prohibited from using NexonHost services for any illegal, unethical, or abusive activities, including but not limited to:

Violating local, national, or international laws.
Harming minors in any way.
Engaging in hacking, phishing, or distributing malware.
Distributing illegal, defamatory, or abusive content.
Misrepresenting or manipulating data transmitted through our services.
Engaging in unauthorized advertising, spam, or fraud.
Disrupting or attacking NexonHost’s systems or services.
Collecting, storing, or publishing personal data without consent.

NexonHost reserves the right to suspend or terminate accounts involved in prohibited activities without prior notice.

05. Limitation of Liability

NexonHost provides its services "as is" and "as available," without any warranties, express or implied. We do not guarantee that the services will be uninterrupted, error-free, or free from harmful components. NexonHost shall not be held liable for:

Data loss, system failures, or delays in operation.
Service outages due to technical issues, force majeure, or acts beyond our control.
Business losses, lost profits, or indirect damages.
Unauthorized access to user accounts due to the user’s failure to maintain secure credentials.

Due to the nature of hosting services, NexonHost does not guarantee absolute protection against cyber threats, DDoS attacks, or third-party interventions. Users are responsible for implementing their own security measures.

06. Content Proprietary Rights & Licensing

All content provided on our Site, including but not limited to text, images, software, and logos, is protected under intellectual property laws. Users may not:

Reproduce, distribute, or modify any NexonHost content without prior written consent.
Use NexonHost services to store, distribute, or facilitate unauthorized copyrighted content.
Host illegal or copyrighted material without the owner’s permission.

NexonHost reserves the right to terminate accounts violating intellectual property rights and report offenders to relevant authorities.

07. Data Processing & Privacy

User data is processed in accordance with our Privacy Policy. By using NexonHost services, you confirm that all provided information is accurate and consent to data processing as outlined in our policy.

NexonHost takes reasonable steps to protect user data but cannot guarantee absolute security. Users must take precautions to secure their accounts.

08. Security & Misuse

Users must not engage in activities that compromise the integrity of our systems, including but not limited to:

Distributing malicious software (viruses, Trojans, worms, etc.).
Conducting DoS or DDoS attacks.
Attempting unauthorized access to NexonHost services or systems.

Any breach of security policies may result in immediate suspension of services and legal action.

09. Account Suspension & Termination

NexonHost reserves the right to determine whether an account has violated these Terms. If so, we may take the following actions without prior notice:

Immediate, temporary, or permanent suspension of access to our services.
Legal action for damages caused by the violation.
Disclosure of user information to legal authorities when required.

NexonHost will not provide refunds for services terminated due to a breach of these Terms.

10. Amendments & Entire Agreement

These Terms represent the complete agreement between NexonHost and its users, superseding all prior agreements or communications.

NexonHost reserves the right to modify these Terms at any time. Users will be notified of changes via email or through updates on the Site. Continued use of services after modifications indicates acceptance of the revised Terms.

11. Governing Law & Jurisdiction

These Terms shall be governed by Romanian law. The Romanian courts shall have exclusive jurisdiction over any disputes arising from the use of our Site or services.
